Terms and Conditions - Isla Grandez

1. Provider / Contracting Party
The contracting party for all orders placed through the online store is:

2. Scope
These terms apply to all orders, deliveries, and services completed through the Isla Grandez online store. By placing an order, the customer accepts the terms and conditions in effect at the time of the order.
3. Offers and Contract Formation
Product listings in the online store do not constitute a legally binding offer, but an invitation to order.
By completing the order process, the customer submits a binding offer to purchase the items in their cart.
Isla Grandez reserves the right to decline orders without stating a reason, in particular in cases of suspected misuse, incorrect information, or payment issues.
4. Products and Availability
All information about products, sizes, colors, materials, images, or availability is provided to the best of our knowledge but without guarantee.
Minor deviations in color, print, material, or finish are possible due to production and do not constitute a defect.
5. Prices and Payment Methods
All prices are displayed at checkout in the selected currency. The price at the time of the order applies.
Only the payment methods offered at checkout are accepted.
6. Shipping / Delivery Areas
We currently ship within Switzerland.
Delivery is made to the address provided during the order process.
Isla Grandez ships to the countries shown as available at checkout. There is no right to delivery to countries not listed.
Partial deliveries are permitted if this is reasonable for the customer.
7. Delivery Times and Shipping Information
Delivery times are estimates. Delivery periods begin after successful payment or payment authorization.
Delays due to force majeure, production bottlenecks, transport issues, customs clearance, regulatory action, or other unforeseeable events cannot be ruled out.
For items in stock, shipping generally takes place based on availability.
8. Preorder Products
Products offered as preorders are labeled accordingly in the store. A note with the estimated delivery window is also included in the order confirmation.
Preorder products are binding orders. Cancellation after the order is completed is not possible.
Stated delivery dates for preorders are non-binding estimates. Delays due to production, quality control, transport, or customs are possible.
9. Customs, Import Duties, and Local Fees
For international deliveries, customs duties, import taxes, handling fees, or other local charges may apply. These costs are the responsibility of the customer.
The customer is responsible for complying with the import regulations of their country.
10. Refused Delivery / Uncollected Shipments
If a shipment is refused, not collected, or returned due to incorrect address details, the customer must contact customer service.
Resulting shipping, return, handling, or customs costs may be charged in a reasonable amount.
11. Retention of Title
Goods remain the property of Isla Grandez until full payment has been received.
12. Right of Withdrawal / Returns
Customers may register unworn, unwashed, and originally preserved items for return within 14 days of delivery.
Returns are handled by contacting customer service at info@islagrandez.com.
The direct cost of return shipping is the responsibility of the customer.
Excluded from the right of return:
- Worn, washed, or damaged items
- Items without tags or original packaging where relevant
13. Refunds
After successful inspection of the returned item, the customer may choose between:
- Store credit
- Refund to the original payment method
Refunds are processed within a reasonable period after receiving and inspecting the return.
Store credit has no expiry date unless otherwise agreed.
14. Exchange
A direct exchange is not guaranteed. Isla Grandez may voluntarily offer an exchange solution where organizationally feasible.
15. Defects / Damaged or Incorrect Items
Obvious defects, shipping damage, or incorrect deliveries must be reported in writing within 5 days of receipt, with clear photos attached.
For valid claims, Isla Grandez will decide at its discretion on a replacement delivery, repair, store credit, or refund.
16. Liability
Isla Grandez is only liable for damage caused intentionally or through gross negligence, to the extent permitted by law.
Liability for indirect damages, consequential damages, lost profits, delayed delivery, or actions of shipping service providers is excluded to the extent permitted by law.
17. Vouchers / Discount Codes
Vouchers, discount codes, and promotions may be subject to conditions and cannot be combined unless explicitly stated otherwise.
18. Misuse / Fraud Prevention
In cases of suspected fraud, abusive chargebacks, multiple orders to circumvent limits, or other misuse, Isla Grandez may cancel orders, refuse deliveries, or restrict customer accounts.
Further legal action remains reserved.
19. Data Protection
The processing of personal data is governed by our separate privacy policy as updated from time to time.
20. Changes to the Terms
Isla Grandez may update these terms at any time. The version published at the time of the order applies.
21. Applicable Law and Jurisdiction
These terms and all contracts are governed by Swiss substantive law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
